Data protection information for applicants

This data protection information explains to applicants to R. Schramm GmbH the nature, scope and purpose of the processing of personal data (hereinafter referred to as “data”) in relation to the application process.

General information

The following information provides a simple overview of which personal data is processed during the application process. Personal data is information that can identify a natural person. Regarding the terms used, such as “processing” or “controller”, we refer to the definitions in the separate chapter of the intranet.

The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data.

How do we collect the relevant data?

We collect personal data from the application documents you submit. These can be submitted in person, by post or by email.

Please note that due to the technical nature of email communication, we cannot guarantee complete confidentiality when sending documents by email.

What data do we process?

General personal data (Art. 6 GDPR)

  • Name of the applicant
  • Address
  • Contact details (email and telephone number)
  • Date of birth
  • School leaving certificate

Special category personal data (Art. 9 GDPR)

  • Gender
  • Marital status
  • Place and country of birth
  • Nationality
  • Parental status
  • Possible severe disability

What is the legal basis on which we process this data?

Art. 6(1)(b) GDPR (initiation and performance of a contract)

This legal basis permits the processing of personal data for the initiation, performance or execution of a contract. This contract takes the form of the employment contract for the advertised position.

Art. 9(2)(b) GDPR (labour law, social protection, social security)

This legal basis permits processing if the controller thereby fulfils its obligations under labour law. This is because an employment contract is being sought.

Why are we processing the data?

  • To manage the application process and potentially initiate an employment relationship

To which internal departments is the data disclosed?

Personal data is disclosed exclusively to the following groups of people:

  • General management
  • Human resources department
  • Site management
  • Department management

Is the data passed on to third parties?

No, no data is passed on to external recipients in the course of application management. No data is passed on to companies or organisations outside the EU.

There is no automated decision-making or profiling.

Does the applicant have to provide the data?

Yes, this processing is essential for the implementation of application management.

The applicant cannot be considered if the data is not provided.

How long will my data be stored?

We only store the data for as long as it is needed for the intended purpose. There are no statutory retention periods.

3 months

All data and documents will be deleted after three months if the applicant is not hired.

With consent, we will store the data until the end of the next application cycle plus three months.

What rights do data subjects have?

  • Right of access (Art. 15 GDPR): Right to access and obtain a copy of the processed data.
  • Rectification (Art. 16 GDPR): Right to rectify inaccurate data.
  • Erasure (Art. 17 GDPR): Right to erasure, provided that no legal provisions prevent this.
  • Restriction (Art. 18 GDPR): Right to restriction of processing, e.g. in the case of disputed data or unlawful processing.
  • Data portability (Art. 20 GDPR): Right to receive the data in a machine-readable format.
  • Right to lodge a complaint: Right to lodge a complaint with a data protection supervisory authority.
